1. About these terms

These Terms & Conditions (“Terms”) govern your use of https://smaartalgos.com (the “Website”) and your purchase and use of products and services offered by SmaartAlgos, a brand operated by Vansh Associates, 43, Ambanagar, Manewada, Besa Road, Nagpur – 440027, Maharashtra, India (“we”, “us”, “our”). By using the Website or placing an order, you agree to these Terms, our Privacy Policy, Refund & Cancellation Policy and Delivery Policy.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to make a purchase.

3. Our products & services

• E-books (PDF) on trading, investing and financial markets.
• Software tools such as TradeSense IQ (stock-analysis software) offered for a fixed plan period (e.g. 3, 6 or 12 months, or lifetime access).
• Expert Advisors / algos such as Goldmine Bot for MetaTrader 4/5, licensed for a single trading account or multiple accounts as per the purchased package.
• Free educational content (Learn guides, calculators) and setup support.

All products are digital. No physical goods are shipped.

4. Educational purpose — not investment advice

Our products and content are provided for educational and informational purposes only. SmaartAlgos / Vansh Associates is not registered with SEBI as an Investment Adviser or Research Analyst and does not provide personalised investment, trading, legal or tax advice, buy/sell recommendations or portfolio management. Any levels, signals, scores, examples or back-test results shown by our software are generated by rules/algorithms for analysis and are not recommendations. You are solely responsible for your trading and investment decisions.

5. Risk disclosure

• Trading in equities, futures & options, currencies, commodities and crypto-assets involves substantial risk of loss, including loss of all capital invested. SEBI studies show that a large majority of individual F&O traders incur losses.
• No profit, income or return is guaranteed. Past performance or back-test results do not guarantee future results.
• Automated tools can fail due to internet, broker, platform, data or software issues. Always test on a demo account first and use appropriate risk settings.
• Indian residents: forex trading is permitted only in permitted currency pairs on recognised Indian exchanges through SEBI-registered brokers; overseas/online leveraged forex or CFD trading is not permitted under FEMA/RBI rules. Crypto-assets are unregulated in India and taxed as per applicable law. You are responsible for complying with the laws that apply to you.

6. Prices & payment

• Prices are shown on the Website in Indian Rupees (INR) or US Dollars (USD). Amounts shown in other currencies are indicative conversions; the final amount charged depends on the payment method and your bank's conversion rates.
• Payments are accepted through secure payment partners (such as Razorpay), UPI, bank transfer and other methods shown at checkout. We do not store your card or UPI credentials.
• Applicable taxes (if any) will be charged as per law.
• We may change prices, offers or plans at any time; changes do not affect orders already paid for.
• An order is confirmed only after successful payment verification.

7. Delivery

Products are delivered digitally as described in our Delivery Policy.

8. Licence & intellectual property

• On full payment you receive a personal, non-exclusive, non-transferable licence to use the product for the purchased plan/period and number of accounts.
• You may not copy, share, resell, redistribute, upload, publicly post, rent, sublicense, reverse-engineer, decompile or modify our e-books, software or EAs, or share licence keys or download links.
• Single Account licences may be locked to one trading account; Multiple Account licences may be used on multiple accounts owned by the purchaser.
• E-book files may carry the buyer's details as a watermark. All content, logos, designs and software remain the intellectual property of Vansh Associates.
• We may suspend or terminate a licence, without refund, in case of misuse, sharing or breach of these Terms.

9. Your responsibilities

• Provide accurate name, phone, email and payment details.
• Keep your licence keys, broker API keys and account credentials secure.
• Use our products lawfully and only with brokers/platforms that are legally available to you.
• Meet the stated system requirements (e.g. MetaTrader version, internet connection, VPS) before purchase.

10. Refer & Earn programme

Participation in our Refer & Earn programme is voluntary and subject to the programme terms on the Refer & Earn page. Commissions are payable only on verified, non-refunded orders. Spam, self-referrals or misleading promotion (including promises of profit or income) lead to disqualification.

11. Third-party services

Our products may work with third-party services such as brokers, MetaTrader, broker APIs, Telegram, TradingView and payment gateways. We are not responsible for their availability, pricing, data accuracy, outages or policies.

12. Limitation of liability

To the maximum extent permitted by law, Vansh Associates shall not be liable for any trading or investment losses, loss of profit, data, opportunity or any indirect, incidental or consequential damages arising from the use of, or inability to use, our products or content. Our total liability for any claim relating to a product shall not exceed the amount you paid for that product.

13. Indemnity

You agree to indemnify and hold harmless Vansh Associates, its founder and team from any claims, losses or expenses arising from your breach of these Terms, misuse of our products or violation of any law.

14. Changes to these terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continued use of the Website after changes means you accept the updated Terms.

15. Governing law & jurisdiction

These Terms are governed by the laws of India. Courts at Nagpur, Maharashtra shall have exclusive jurisdiction, subject to applicable consumer-protection laws.
